1. Acceptance of Terms

By accessing or using Kivio (“the Service”), operated by Kivio (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Kivio provides an interactive email widget builder platform for e-commerce merchants. The Service includes tools for creating interactive email experiences such as reviews, surveys, upsells, and SMS signups, along with integrations with email service providers and e-commerce platforms.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

4. Subscription and Billing

4.1 Plans and Pricing

The Service offers multiple subscription tiers with varying features and usage limits. Prices are displayed on our website and may change with 30 days' notice.

4.2 Payments

Payments are processed through Stripe. You authorize us to charge your payment method for the recurring subscription fee. Subscriptions auto-renew unless canceled.

4.3 Refunds

Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time, effective at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service to send spam or unsolicited communications
  • Violate any applicable laws, including CAN-SPAM, GDPR, or similar regulations
  • Attempt to disrupt or interfere with the Service or its infrastructure
  • Reverse-engineer, decompile, or otherwise attempt to derive source code from the Service
  • Resell or redistribute the Service without our written consent
  • Use the Service to collect personal data without appropriate consent

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Kivio and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you create using the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

8. Third-Party Integrations

The Service integrates with third-party platforms (Klaviyo, Shopify, WooCommerce, etc.). Your use of these integrations is subject to the respective third-party terms. We are not responsible for the availability or performance of third-party services.

9. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service with reasonable notice. During the beta period, features may change without notice.

10. Limitation of Liability

To the maximum extent permitted by law, Kivio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Kivio, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account by canceling your subscription and contacting us. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
